Registrant Agreement

By registering domains through Uni Web Serve cc, the client accepts the terms on this registrant agreement for registrations, transfers and/or updates to domain names in ICANN TLD namespaces and all South African namespaces under ZA Registry.

  1. Applicability

    1. Each registry is responsible for assigning domain names in its managed namespaces. These terms apply to all domains registered via the Registrar. The applicant/registrant agrees to be bound by all published policies and terms on this site.

 

  1. Fees and Payment

    • Refer to the standard Terms as they relate to fees 

    • Should the applicant/registrant fail to settle any fees on the due datewe may, without derogating from any other right in this agreement or otherwise and without notice, withdraw the domain name application or registration. 

    • Under no circumstances will we be obliged to refund any fees paid by the applicant/registrant.

    Rights to Domain Name | Domain Ownership Disputes 

    • We will under no circumstances whatsoever be obliged to determine the right of the applicant to any domain name. Domain names are delegated on a “first-come-first served” basis and in no way constitutes any support or warranty of the applicant’s right to utilise such name. 

    • We give no warranties of any nature whatsoever with regard to domain names nor the registration or use thereof. We disclaim all such warranties express or implied. 

    • Under no circumstances whatsoever will we be obliged to act as an arbiter of disputes arising out of the registration and use of the domain name. 

    • Should a third party present us with prima facie evidence that indicates that the domain name violates the rights of the complainant or the law, then we are entitled to provide the complainant with the registrant‘s full name and contact details. All further communication will exclude us and we will have no further obligations to the registrant or complainant. 

    • The applicant/registrant accepts the jurisdiction of any dispute resolution process in respect of the namespace by the relevant registry, ICANN or by the law, in disputes relating to domain names, incl. the Uniform Domain Name Dispute Resolution Policy and the Uniform Rapid Suspension, and agrees to be bound by any decision that may result.

    The Applicant/Registrant’s Duties 

    1. The applicant/registrant must provide us with accurate contact information and update them within one week of any change occurring during the period of the domain name registration, incl.:

      • full name, postal address, email address, tel. number and registered company name (where applicable) 

      • name of authorized contact in the case of an applicant/registrant that is a representative of a company or organization; 

      • full name, postal address, email address, tel. number and registered company name (where applicable) of the technical contact for the domain 

      • full name, postal address, email address, tel. number and registered company name (where applicable) of the administrative contact 

    1. The applicant/registrant’s provision of inaccurate or unreliable information, failure to update information provided to us within 7 days of any change, or failure to respond for over 15 days to registrar enquiries concerning the accuracy of contact details associated with the applicant/registrant’s registration constitutes a material breach and is a basis for suspension and/or cancellation of the domain name registration, without any further notice.

       

      Any applicant/registrant that intends to register a domain name on behalf of a third party is nonetheless the applicant of record and is responsible for its own complete contact details and for keeping this info updated for all contacts (applicant/registrant, technical and administrative) and to ensure timely resolution of any issues that arise with regards to the domain name. An applicant/registrant licensing use of a domain accepts liability for any damage caused by wrongful use of the domain name unless it discloses the current contact details and identity of the licensee within 7 days to a party providing them with reasonable evidence of such damages.

       

    The Applicant/Registrant’s Warranties and Indemnity 

    1. The applicant/registrant hereby irrevocably represents, warrants and agrees that:

      • the details provided in the application is accurate and complete 

      • that it will keep such details up to date on an ongoing basis; 

      • that it has the right to use and register the domain name; 

      • to the best of its knowledge the registration doesnt infringe any legal rights of another with respect to any intellectual property right or trademark; 

      • will not use the domain name for unlawful purposes, including but not limited to: distribution of malware, botnets, defamation, hate speech, phishing, piracy, counterfeiting, fraud, pyramid schemes; 

      • it must have at least two active nameservers for the domain name.  

      • it has selected the domain name without any input, influence or assistance from us

      The applicant/registrant agrees that it will defend, indemnify and hold harmless the Registrar and the Registry, their directors, officers, members, employees and agents, for any loss, damage, expense or liability arising from any claim or action related to a breach of the abovementioned warranties or the use of the domain name, including attorneys’ fees. Such claims include, but are not limited to, those based upon trademark infringement, copyright infringement, dilution or defamation. We agree to give the applicant/registrant written notice of such claims, actions or demands within reasonable time of becoming aware of it. The applicant/registrant agrees that the Registry and/or the Registrar will be defended by attorneys of their own respective choices at the applicant/registrant’s expense, and that the applicant/registrant will advance the costs incurred in such litigation to the respective parties as required.

       

    Suspensions, Cancellations, Transfers 

    1. The applicant/registrant agrees that its registration of the domain name may be suspended, cancelled, or transferred:

      • should the applicant/registrant breach any warranty 

      • if the applicant/registrant withdraws its consent for processing of personal information 

      • should the applicant/registrant breach any other provision of this agreement and fail to remedy it within 14 days of receiving written notice to do so; 

      • in order to correct mistakes by Registrar or the Registry in registering the domain name according to ICANN policy 

      • on receipt of an order by any court having jurisdiction 

      • on receipt of a decision by a dispute resolution provider appointed in terms of an official domain name Dispute Resolution Procedure introduced by law, or adopted and published by the Registry or ICANN 

    • to correct mistakes or for resolution of disputes concerning the domain name 

    • In the event that the registrar’s accreditation is withdrawn by the registry, the registry may initiate a forced transfer of the domain to another registrar

    Personal Details 

    1. Personal info provided by the applicant/registrant will only be used for:

      • providing registrar and registry services and in particular  

      • providing a public WHOIS facility 

      • to affiliated service providers for the purposes of providing registry services; 

      • to a third party replacing the Registry in providing the Registry function in terms of the registry agreement between ICANN and the Registry, whether located inside or outside South Africa.

      THE APPLICANT/REGISTRANT CONSENTS TO THE MANAGEMENT OF PERSONAL DETAILS AS DESCRIBED AND ACKNOWLEDGES THAT DOMAIN NAME REGISTRATION, TRANSFER OR RENEWAL IS DEPENDENT ON SUCH CONSENT.

      THE APPLICANT/REGISTRANT WARRANTS THAT WHERE IT SUPPLIES THE PERSONAL DETAILS OF 3RD PARTIES THAT IT HAS FIRST PROVIDED SUCH THIRD PARTIES WITH EQUIVALENT NOTICE AND OBTAINED THEIR CONSENT IN TURN FOR SUCH ACTION.

      We undertake reasonable technical and organisational measures to protect the personal information.

      Provision of the domain name is dependent on the applicant/registrant’s consent, and such provision may be suspended or withdrawn if the applicant/registrant withdraws such consent.

    Exemption and Indemnity of the Registry 

    • THE REGISTRY, ITS DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS WILL UNDER NO CIRCUMSTANCES WHATSOEVER BE LIABLE FOR ANY DAMAGES OF ANY KIND REGARDLESS OF THE FORM EVEN IF THE REGISTRY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. 

    • THE APPLICANT/REGISTRANT WILL INDEMNIFY, DEFEND, AND HOLD THE REGISTRY AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS HARMLESS AGAINST ANY CLAIMS, DAMAGES, LIABILITIES, COSTS, AND EXPENSES (INCLUDING REASONABLE LEGAL FEES AND EXPENSES) RELATING TO OR ARISING OUT OF THE APPLICANT/REGISTRANT‘S DOMAIN NAME REGISTRATION. 

    1.  

    General 

    • Adjudication of any legal disputes will take place in CAPE TOWN 

    • This agreement will be interpreted in accordance with the law of the Republic of South Africa 

    • The applicant/registrant acknowledges that the Registry or ICANN may oblige the Registrar to modify the agreement from time to time. 

    • The applicant/registrant accepts that it is incumbent on it to monitor such changes and hereby agrees that should it fail to notify us of their wish not to be bound by such amendments within 30 days of such amendment being published, it will be deemed to have acceded and agreed to the amendments. 

    • In the event that any of these terms are found to be invalid, unlawful or unenforceable, such terms will be severable from the remaining terms, which will continue to be valid and enforceable.
